The U.S. Department of Justice submitted a legal document in favor of the AI industry in a copyright battle with the New York Times. This submission backing OpenAI and Microsoft was not coordinated with the federal agencies that manage intellectual property, and no career antitrust attorneys signed the document.
The filing surprised officials at the U.S. Copyright Office and the Patent and Trademark Office. These agencies work directly on the copyright issues at the center of the lawsuit, and the Justice Department aligned its position with the technology companies without their prior input.
